Acceptance
By using cup-tops.com, requesting paid custom work, or placing an order, you agree to these Terms of Service and any incorporated policies, including Custom Order Terms, Final Sale / No Returns Policy, Shipping & Delivery Policy, Product & Safety information, and Privacy Policy.
Seller
Products are sold by Anzhelika Cherkashina. “CupTops” is used as the product and marketing name.
Product information
We try to describe products and custom options accurately. Because products are made to order and colors vary by screen and filament batch, photographs, renders, dimensions, and colors are approximate unless the written order states otherwise.
Pricing
Current published pricing is shown in our Pricing Guide. Multicolor prices are “from” prices. Complex, oversized, highly detailed, or unusual designs require an individual quote. Shipping and applicable tax may be additional.
Order acceptance / refusal
Seller may decline or cancel a request before production if it is not feasible, unsafe, unlawful, infringing, outside production capabilities, or cannot be completed on the agreed terms. If Seller cancels an already-paid order before fulfilling it, Seller will provide any refund or other remedy required by applicable law or the governing payment platform.
Custom orders
Custom orders are additionally governed by the Custom Order Terms. If there is a conflict, the specific written quote / invoice and the Custom Order Terms control for that custom order.
Website intellectual property
Unless otherwise indicated, original website text, original photographs, original graphics, product concepts, and Seller-created designs are owned by or licensed to Seller and may not be commercially copied or reproduced without permission, except as allowed by law.
Prohibited use
You may not misuse the website, attempt unauthorized access, submit unlawful or infringing material, use the site to commit fraud, or falsely represent affiliation with Seller.
Disclaimer
To the fullest extent permitted by law, the website and its content are provided on an “as available” basis, and Seller disclaims warranties not expressly stated in a written order. Nothing here excludes rights or warranties that cannot legally be excluded.
Limitation
To the fullest extent permitted by law, Seller will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or products. To the fullest extent permitted by law, Seller’s aggregate liability relating to a particular order will not exceed the amount actually paid to Seller for that order. These limitations do not apply where prohibited by law.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Changes
We may update these Terms for future use. Changes do not retroactively alter a completed order unless required by law or agreed in writing.
